Who are the Wiseguys?
WISEGUYS.CO.NZ is operated by Buy Now NZ Limited, and in these terms we refer to ourselves as "we", "us" or as "the seller". The customer will be referred to as "you" or "the buyer".
Scope of terms and conditions
These Terms and Conditions shall prevail over any terms contained in any order or offer made by us.
The buyer may order products from us by completing and submitting the checkout process on this website. It is the buyer's responsibility to provide all information correctly (including name, email address, and payment details) so that the order can be processed correctly.
Contracting to supply goods
This website invites you to buy. When you order this is an offer by you to buy in accordance with these terms and conditions. We accept the offer and form the contract when the goods are dispatched.
The Consumer Guarantees Act (1993)
As per the Consumer Guarantees Act 1993 (Act):
- If the buyer is purchasing the goods (or services) for a non-business purpose then these terms will be interpreted subject to the Act and these terms will not limit the buyer's rights under the Act.
- If the buyer is purchasing the goods (or services) for the purpose of a business then the buyer agrees that the Act doesn't apply.
In relation to both a. and b. above, we do not provide an Express Guarantees as defined in the Act, which is provided by the manufacturer of the item.
Changing your mind
Please carefully consider before buying an item. We aren't obliged to accept a return if you've reconsidered and no longer want the item, but often we can accommodate your request. In this case, please expect to pay the cost of returning it. Further, you will be responsible for ensuring that the item is returned to us safely, so we recommend you use tracking and insurance.
Buy Now NZ Limited is a NZ registered company and pays GST. That means that all products and services have a GST component of 15% and all prices are quoted inclusive of this tax. Our GST number is 106-490-023.
Ownership of goods in case of part payment
We own all goods supplied until we have received full payment.
Damaged or incorrect orders
If you've received the wrong product or it has been damaged in transit please tell us within 5 days of receiving them. If you don't, then it will be taken that you agree that the correct goods have been delivered and that they are in good order (this doesn't affect any Consumer Guarantees Act rights).
Responsibility of goods in transit
We are responsible for goods when they are in transit (they are covered by our insurance with our delivery agent). Risk passes to you when you collect the goods or somebody does this on your behalf.
We make every endeavour to keep our stock levels up to date, by a very sophisticated system (we are Wiseguys) that is pretty much foolproof. If we are not able to supply the stock, it will be notified on the website as quickly as our system allows. If we can't supply the item purchased we will let you know as soon as possible and refund your money in full.
The prices quoted on the website are related to the particular stock we have available at that time. Prices may change from day to day depending on supply. Unless there has been a genuine mistake with the pricing, once you have purchased an item at the price quoted we will supply the item at this price.
Even Wiseguys stuff up. We don't want to make mistakes and believe that the success of our business is built firstly on not making mistakes, and secondly if we do, by doing our best to rectify them and making sure that you, our customers, receive excellent service from us. If something is wrong, please let us know and we will work hard to make it right.
The Act of God
We won't be responsible to you for any loss or damage directly or indirectly arising from or in connection with an anything beyond or control, or an Act of God. By this we mean natural or man-made disasters such as earthquakes, fires and floods. This could also mean civil commotion, government intervention, transport delays, accidents, labour disputes and anything else beyond our reasonable control.
Fit for purpose
Please make sure that the goods are fit and suitable for the purpose you are purchasing them for, because we don't provide any guarantee that they will meet your needs. If we are ever held liable to you, our liability is limited to either providing you a refund or replacement, as decided by us.
We will not be liable for any loss of profits or any indirect or consequential loss due to the products not being fit for purpose, even if the possibility of such loss has been brought to our attention.
This clause is of course also subject to any rights you may have under the Consumer Guarantees Act.
When we accept your order then the terms and conditions on this website, along with additional terms we've advised you of or agreed to in writing, then this is the entire agreement between us. You agree that there are no other understandings, representations or warranties forming a part of this agreement.
This agreement is subject to NZ law
- Governing law
- The contract (and these terms) are governed by the laws of New Zealand.
- If we waive one default it doesn't mean that we waive of any later default (even if it's the same type of default). If we fail to exercise any right (or delay in doing so) it doesn't mean we waive that right.
- No assignment
- You cannot assign or transfer this contract without our prior written consent.
- Shipping rates will vary depending on your location in New Zealand. This will be displayed on the checkout page before you submit your order.
- All of our packages are delivered by courier and can be traced. We have a number of selected shipping partners.
Delivery times can vary from product to product. Please view product specific delivery times on each product page. The following is a guide only:
- 1 - 2 working days
- North Island (apart from Auckland)
- 2 working days.
- South Island - Road
- 2 - 3 working days
- South Island - Air
- 1 - 2 working days
Returning items and warranties
You may return products which:
- Are the wrong product
- Are damaged in transit
- Are faulty on arrival
- Break down within the warranty period
Wiseguys will cover the courier charges to return the product to base unless the product is being returned due to a breakdown within the warranty period where by the customer will be responsible for courier costs as per standard return to base (RTB) warranties.
For any warranty claims please contact email@example.com in the first instance. The next step is to arrange the return of the item to Wiseguys.
Payment can be made by either:
- Credit card / debit card
- or direct credit to our bank account
Payment via credit card/ debit card is processed through our secure DPS gateway as supplied on the website. DPS is a secure and highly regarded internet payment gateway (please see the following link for further information: http://www.paymentexpress.com).
Payment may also be paid by direct credit to our bank account. When paying by this method we cannot dispatch the goods until we have confirmed receipt of funds the day after your order.
All credit card / debit card payments processed through our secure DPS gateway will appear on your cardholder statement as payments to ‘www.wiseguys.co.nz’.
